What we collect, and what we do with it.

1. Introduction

Performance Culture Consulting (“PCC”, “we”, “us”) is a management consulting firm serving telecom operators, technology companies and their partners. We are sensitive to privacy issues with respect to the information provided to us and are committed to maintaining the privacy and confidentiality of the personal information we collect.

This policy explains what we collect through this website, through our business development activities, and in the course of delivering consulting services to our clients.

2. Who this policy covers

This policy applies to visitors to this website, prospective clients who contact us or complete the PCC Business Performance Diagnostic™, and individuals who interact with PCC as representatives of a client, partner or supplier.

It does not cover information about businesses or legal entities, information we hold about our own personnel, or personal information that we process solely on behalf of a client under that client's instructions. Where PCC processes information on a client's behalf, the client is the data controller and that client's privacy notice governs.

3. Information we collect

We collect only what we need to respond to you and to deliver consulting services.

  • Contact information you submit: name, business email, phone number, company and the details you provide about your business challenge.
  • Diagnostic responses: the answers you give in the PCC Business Performance Diagnostic™ and the resulting scoring output.
  • Meeting requests: preferred calendar, date, time and event or conference selection.
  • Engagement information: materials, documents and data a client shares with us during a consulting engagement.
  • Technical information: basic log and analytics data such as pages viewed, referring source, approximate location, browser and device type.

4. How we use information

We use personal information to:

  • Respond to inquiries, schedule conversations and confirm requested meetings.
  • Generate and deliver your diagnostic results and related recommendations.
  • Scope, propose, deliver and administer consulting engagements.
  • Send information about consulting services you have asked about, and occasional PCC research or event notices you may opt out of at any time.
  • Maintain the security, integrity and performance of our systems, and meet legal, regulatory and contractual obligations.

5. Consent and your choices

When you submit a contact or diagnostic form, you consent to PCC contacting you at the email address or telephone number provided in order to respond to your request and discuss consulting services. Consent is not a condition of any consulting engagement or of becoming a client.

You may withdraw consent, ask us to stop contacting you, or request access, correction or deletion of your personal information at any time by emailing us. We will respond within 30 days of receiving a verifiable request.

6. Information we share

We do not sell personal information. We share it only as follows:

  • Service providers. Vendors who host our website, manage our email, scheduling and CRM systems, and provide analytics, each bound by confidentiality and data-protection obligations.
  • The PCC Network. Where you ask us to make an introduction, we share only the information necessary to make that introduction, and only with your knowledge.
  • Client engagements. Where we act on a client's behalf, we share information with that client and with third parties the client authorizes.
  • Legal requirements. Where disclosure is required by law, regulation, subpoena, or to protect the rights, property or safety of PCC or others.

7. Confidentiality of client information

Consulting engagements routinely involve commercially sensitive information. PCC treats client materials as confidential, restricts internal access to the personnel who need it to perform the work, and uses client information only to deliver the agreed services. Case studies, benchmarks and aggregate engagement data are anonymized and de-identified unless the client has given written permission to be named.

8. Security

We maintain administrative, technical and physical safeguards designed to protect against unauthorized access to, or alteration, disclosure or destruction of, personal information. These include access controls, encryption in transit, vendor risk review and periodic review of our collection, storage and processing practices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Retention

We retain personal information only as long as necessary for the purposes described in this policy, to satisfy our contractual, legal, accounting and regulatory obligations, and to resolve disputes. When information is no longer needed we delete or anonymize it.

10. Cookies and analytics

This website uses a small number of cookies and similar technologies to operate the site, remember your display preferences, and understand aggregate usage. You can control cookies through your browser settings; disabling them may affect site functionality.

11. Third-party links

Our site and materials may link to third-party websites, scheduling tools or partner resources. We are not responsible for the privacy practices of those third parties, and we encourage you to review their notices.

12. Children

Our services are directed to businesses. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us information, contact us and we will delete it.

13. Changes and contact

We may update this policy from time to time. Material changes will be reflected by a revised effective date on this page.

Terms of Service

The terms that govern this site and our work.

1. Acceptance of these terms

These Terms of Service govern your use of this website and any content, tools or materials made available through it, including the PCC Business Performance Diagnostic™. By using the site you agree to these terms. If you do not agree, please do not use the site.

2. Consulting services are governed by a separate agreement

Nothing on this website constitutes an offer to perform consulting services or forms a consulting engagement. Consulting services are provided only under a separate written agreement, statement of work or order form executed by PCC and the client, which defines the scope, deliverables, fees, timing, personnel and governing terms. In the event of any conflict, that signed agreement controls over these terms.

3. Informational purposes only — no professional advice

The content on this site, including diagnostic results, benchmarks, case studies, playbooks and recommendations, is provided for general informational purposes. It is based on limited inputs, dummy or illustrative data in some cases, and general industry patterns, and it is not legal, regulatory, tax, accounting, financial or investment advice.

You should not act on this content without obtaining professional advice specific to your circumstances. Any figures, outcomes or timeframes shown are illustrative and are not a prediction, warranty or guarantee of results.

4. The PCC Business Performance Diagnostic™

The diagnostic produces a directional, self-reported assessment of where your business may be constrained. Its output depends entirely on the accuracy of the answers submitted. PCC makes no representation that the output is complete, accurate or suitable for any particular decision. Submitting the diagnostic does not create a client relationship.

5. Your submissions

You agree that information you submit is accurate, that you are authorized to submit it on behalf of your organization, and that it does not include confidential information of a third party, personal health information, payment card data, or any other sensitive data we have not requested. Do not send confidential material before a written confidentiality agreement is in place.

6. Communications consent

By submitting a form on this site you agree that PCC may contact you at the email address and telephone number you provide about your request and about PCC consulting services. Message and data rates may apply. Consent is not a condition of any consulting engagement or of becoming a client, and you may opt out at any time.

7. Intellectual property

The site and its content — including text, graphics, frameworks, methodologies, the PCC name and marks, and the PCC Business Performance Diagnostic™ — are owned by PCC or its licensors and are protected by intellectual property laws. You may view and print content for your own internal business evaluation. You may not copy, republish, resell, modify, reverse engineer or create derivative works from it without our prior written consent. Ownership of engagement deliverables is addressed in the applicable written agreement.

8. Acceptable use

You agree not to:

  • Use the site for any unlawful purpose or in violation of these terms.
  • Attempt to gain unauthorized access to the site, its systems or related networks.
  • Scrape, harvest, or use automated means to collect content or contact information.
  • Introduce malware, interfere with site operation, or impose an unreasonable load on our infrastructure.
  • Misrepresent your identity or affiliation.

9. Third-party content and links

The site may reference third-party organizations, tools, scheduling providers and resources. Such references are not endorsements, and PCC is not responsible for third-party content, services or practices.

10. Disclaimer of warranties

The site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. PCC does not warrant that the site will be uninterrupted, error free or secure.

11. Limitation of liability

To the maximum extent permitted by law, PCC and its members, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising out of or relating to your use of this site or reliance on its content, even if advised of the possibility of such damages. PCC's aggregate liability arising from use of this site will not exceed one hundred United States dollars (US$100). Liability arising from a consulting engagement is governed exclusively by the applicable written agreement.

12. Indemnification

You agree to indemnify and hold harmless PCC from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your misuse of the site, your violation of these terms, or your violation of any law or third-party right.

13. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or the site will be resolved in the state or federal courts located in Florida, and you consent to their exclusive jurisdiction. Each party waives any right to a jury trial and to participate in a class action to the extent permitted by law.

14. Changes to these terms

We may modify these terms at any time by posting a revised version with a new effective date. Continued use of the site after changes take effect constitutes acceptance. If any provision is found unenforceable, the remaining provisions remain in full force.
